Privacy Policy

This Privacy Policy explains how we collect, use, disclose, and process your Personal Information when you use AL, the artificial intelligence platform and technology brought to you by Signal Theory, Inc. This Privacy Policy also describes your rights with respect to personal information you provide, or that we may obtain from you. We urge you to read this Privacy Policy carefully and check back periodically so you remain aware of the provisions that apply to you, as well as the rights you have with respect to the information we obtain. Any terms that are not defined in this Privacy Policy have the meaning defined in our Terms of Use.
As you read through this Privacy Policy, understand that we use the term “Personal Information” to mean and refer to any personal information, personally identifiable information, personal data and any other information the law characterizes, considers and/or defines as information that is legally protectible as a matter of law and over which you have specific rights.
What Personal Information Do We Collect?
Information You Provide
We collect Personal Information you provide to us when you register and set up an Account (or attempt to do so). Personal Information such as your name, email account address, phone number and information such as your User ID and other information related to our ability to identify and authenticate you as a user, allowing you to log in and use AL. We also collect Personal Information related to your payments mechanisms that allow us to bill and collect the Fees that are due to us as part of your use of AL.
In addition, when you use AL, since AL allows you to prompt, make inquiries and submit a wide variety of digital content and information and to the extent there is any Personal Information in those Inputs, we have access to and obtain that Personal Information. You should be aware that Personal Information contained in your Input may also be reproduced and found in your Output.
Of course, if you communicate or interact with us for customer service, help, providing us with feedback, comments or suggestions and you include any Personal Information (e.g., contact information), we obtain and store that information as well.
Information We Obtain Automatically
When you use AL, we also receive certain types of technology-related information automatically and which the law may characterize as Personal Information.
For example, the device you use to interact with AL, the browser or other software and programming may automatically send us Personal Information. Information related to your use of AL, how, when and from where use AL – information such as the operating system used by your device and what kind of device it is, the Internet service provider (ISP), your IP address (which may also give us location information), the operating system and browser you are using and whether you were referred by or arrived at AL’s web page through or from another web page. If you are using a mobile device, the information may include which mobile network you are using, as well as your unique device identifiers. These and other unique online or personal identifiers are part of the Personal Information that may be available to us automatically.
When, from where and how you use AL are also part of the Personal Information we collect. The history of your use, your Input, the hypertext links you select (click), what web pages you view and all the activity you engage in to interact with us and with AL are part of what the law considers Personal Information that we collect.
To collect this information automatically, we and any third party service providers we may engage in support of AL, use web beacons, invisible GIFs, pixel tags, scripts and so called ‘cookies’ to manage and collect this information and they do so automatically (“Cookie Technology”). Cookie Technology helps us recognize, identify and authenticate you as an authorized user, and allows us to customize your user experience, make your use of AL more efficient and much safer. Cookie Technology, together with the log files related to your use of AL, allows us to investigate and collect information about errors or problems you may experience – when the error happened, what feature or function you were using at the time, and any other information related to the problem our systems capture as you use AL.
Not only does Cookie Technology allow us to analyze your use of AL and help us improve AL or correct issues that arise, but it also allows us to market and promote products and services in which we think you may have an interest. Consistent with applicable laws and regulations, we will always give you some degree of control over what type of Cookie Technology you allow us to use when you use AL, but there may be times when your choices will make certain features or functions of AL unavailable or not work properly. In addition, as we describe later in this Privacy Policy, you always will have the right to opt-out of receiving unsolicited marketing communications.
We also my collect and use Personal Information to “train” AL but for that purpose we only use information that is publicly available, that is properly licensed from a third party and that we are free to use for training purposes and, of course, information from Input, Output and Content based on your use of AL. AL is not directly connected, nor does AL automatically interact with the Internet, the World Wide Web or any other artificial intelligence platforms or technology.
How, Why and For What Purposes Do We Use Personal Information?
We will only use your Personal Information in accordance with applicable laws. As noted in our Terms of Use, at this time AL is only available to users who are legal residents of the United States. If you are not a legal resident of the United States, and in violation of the Terms of Use you register, attempt to register, use or attempt to use AL, you will be unconditionally and irrevocably be voluntarily agreeing to be subject to the exclusive jurisdiction and application of the Federal and State laws and regulations applicable to legal residents of the United States and waive any right you may have to assert or take advantage of the laws, regulations, judicial or other governmental laws, regulations and rights you may have that apply in any other jurisdiction, including your actual legal citizenship or residence.
We use your Personal Information in the following ways:
· To establish an Account, establish, perform and, if necessary, enforce your Agreement with us;
· To perform the services and obligations and/or exercise our rights under our agreement with you. For example, we may need to send you notices about your Account, updates to our Terms of Use and this Privacy Policy, to process payments applicable to the Fees you are obligated to pay, and to respond to inquiries and process transactions you initiate;
· To provide necessary services, support, make corrections and to properly maintain the operation, integrity, security and functioning of AL, the services we make available to you as a user and your Account with us;
· To protect our rights and the rights of others, including the security, safety and integrity of AL and the systems and technology supporting AL;
· To identify, detect, investigate and prevent any abuse, misuse, fraud, unauthorized use, criminal activity or any other violations or breaches of our Terms of Use or this Privacy Policy and to enforce our rights;
· To supplement our research and development efforts in order to improve AL, develop new or enhanced features, functions or capabilities;
· To market AL and the services and resources we make available to users;
· To comply with our legal and regulatory obligations, which may include providing Personal Information in response to governmental and judicial requirements, as well as reporting possible violations to law enforcement agencies as and when, in our sole determination, we believe it is appropriate to do so; and
· Whenever you give us your express consent – which you will always have the right to revoke or withdraw at any time.
Any time we use or are using your Personal Information, it is protected with reasonably industry-standard commercial internal access and security controls, and is encrypted at rest and in transit.
We can also aggregate and/or de-identify your Personal Information in a way that renders your Personal Information unidentifiable or linked to you or any other person so that we can use that information to analyze the effectiveness, operations, and actual usage and use that information in order to improve AL’s capabilities and provide more accurate and helpful services based on use of AL by users.
We will not use any of your Content, Inputs or Outputs to train AL, unless:
· We detect or have reason to suspect these may represent abuse, misuse, fraud, unauthorized use, criminal activity, violations or breaches of our Terms of Use or this Privacy Policy, threats to the security, integrity, operation or functioning of AL, us, any other user or any third party and we may use any or all such Content, Input and Output to train AL and our systems to better detect and prevent such activity or use; or
· When you provide us with feedback and suggestions or you have a dispute with us relating to AL or the services we make available, we will disassociate any Content, Input or Output information you provide from your User ID and Account so that we can train AL and learn from these situations;
· You have expressly and separately communicated with us (other than to provide specific feedback or in connection with a dispute) and included content, information or data contained in your Content, Input or Output for any reason, including providing us with feedback, suggestions or comments regarding AL and the services we make available; or
· You have given us permission to use your Content, Input and/or Output for training purposes – which you have the right to revoke or withdraw at any time. Although we will not remove any Content, Input, Output or other information you previously consented and allowed us to use to train AL, we will cease using any further and subsequent Content, Input or Output once we receive and process your revocation or withdrawal request.
When and Why Do We Disclose Personal Information
We reserve the right to disclose your Personal Information:
· To our operational service providers, such as website hosting and management companies, as well as those responsible for ensuring compliance with legal, regulatory, security and other obligations;
· To auditors, lawyers and other professionals who have a need to know or review Personal Information in the course of providing services to us;
· In connection with major corporate transactions or events, such as a restructuring, merger or in any circumstances where the transfer of assets are involved and the transaction or event would routinely require diligence, evaluation, review or disclosure;
· In response to governmental, regulatory, judicial, law enforcement or other legal requirements, including tax or accounting purposes or assist in investigations;
· To protect the security, safety, integrity and operation of AL, the rights of others, including the prevention of fraud, criminal activity or any other breach or violation of the Terms of Use or this Privacy Policy;
· To enforce the provisions of your Agreement with us, including disclosure under circumstances we reasonably determine or suspect may be appropriate to protect your health and safety or the health and safety of any other person or to prevent property damage;
· In connection with legal or regulatory proceedings, demands and claims, disputes or litigation or as may otherwise be permitted or required by law; and
· Whenever you give us your permission or instruct us to disclose your Personal Information.
We do not sell or share or otherwise provide any of your Personal Information we collect, maintain or use in connection with AL and your Agreement with us, to third parties.
You Have Certain Choices and Rights
Depending on your particular legal residence in the United States, you may have specific legal rights that apply to your Personal Information. Please understand that different laws and regulations may apply to different users in different locations. Consequently, the process we may be required to follow in responding to your requests, if we have an obligation to respond, may be different for different users. The laws and regulations vary and are complex, so if you want to exercise your rights either you, or your authorized agent, must send us your request using the contact information below. When we receive such a request, we may require you (or your agent) to provide us with sufficient information to enable us to authenticate and verity your identity (and, if applicable, the identity and authority of your agent). If we deny your request, if you have a right to appeal our decision and you should use the same contact information below. We will follow the same procedures to confirm identity and authority, as needed.
You may have a right:
· To know what Personal Information we have about you, our sources of Personal Information, and the purpose for which we obtained your Personal Information;
· To know what types of Personal Information we collect and the types of third parties to whom we disclose Personal Information;
· Subject to certain exceptions, to ask us to correct inaccurate Personal Information we have about you;
· To ask us to send you a copy of the Personal Information we have about you; and
· To delete and erase Personal Information collected in connection with your use of AL, including your Account information and your interactions with us.
· To opt out of our using your Personal Information to send you unsolicited marketing and promotional messages and we will enable you to do so by using an unsubscribe hypertext link in our email communications (or if you have previously consented to receive marketing or promotional messages by SMS/Text messaging, send us a STOP request).
· To notify us of an objection to our use of all or some of your Personal Information. If you have that right, unless we can provide compelling and legally defensible grounds that supersede your rights (or your freedom or interests), for example if we need your Personal Information to exercise our rights at law, in equity or under your Agreement with us or in order to defend ourselves in legal or regulatory proceedings. or for the establishment, exercise or defense of legal claims.
· If collecting, storing, using or processing your Personal Information is based on your consent, you have the right to revoke your consent, in whole or in part, or limit our use of your Personal Information.
Bear in mind that when you exercise these rights and request us to correct information, to delete information, object to our use or maintenance of your Personal Information, several things may happen. If the Personal Information is part of your Account information, it may compromise or impair our ability to authenticate you as a user, process payments and adversely affect other aspects of our ability to properly operate AL and allow you to us AL. Consequently, while we will always comply with the laws and regulations that apply to you and your rights, we correspondingly reserve the right to terminate, cancel and revoke your authorization to use AL if you ask us to do any of these things.
In addition, if you have the right to submit a correction request, we will make reasonable efforts to make the correct, however, given the complexity of artificial intelligence platforms, technology and systems, it may not always be possible for us to ensure corrections are propagated throughout AL. Similarly, we have no way and cannot guarantee the accuracy of any Output generated by AL and if any Output contains factually inaccurate Personal Information about you, we have no practical way to correct or remove that information.
How Long Do We Keep Personal Information
We only keep your Personal Information as long as reasonably necessary for the purposes and criteria outlined in this Privacy Policy. Once your Personal Information is no longer required or permitted to be kept, we will take the necessary steps to destroy, erase, delete you Personal Information or convert your Personal Information into anonymous, de-identified form.
When the Personal Information collected is no longer required by us, we and our service providers will perform the necessary procedures for destroying, deleting, erasing, or converting it into an anonymous form as permitted or required under applicable laws.
You should understand that not all of these rights may be applicable to you, may not apply in all circumstances and there may be exclusions, exceptions or exemptions that would allow us to continue to use and retain your Personal Information, notwithstanding your requests or attempt to exercise some of these rights – they are not unconditional or absolute.
Changes to Our Privacy Policy
We may amend and update this Privacy Policy at any time and from time to time. We will provide you with prior notice of any material changes and/or amendments using the contact information in your Account and by posting an amended version of this Agreement at al.chat/privacy If you disagree with any amendments, you may terminate this Agreement by closing your Account and ceasing to use AL at any time before the amendments take effect, but if you don’t, you will be deemed to have accepted and agreed to the Privacy Policy, as amended.
